Photography Gallery Terms of Service

Welcome to your online gallery. By accessing or downloading images from this gallery, you (the "Client") agree to be bound by the following terms and conditions.

1. Grant of License

Upon full payment of your session fee, De La Mora Photography, LLC (the "Photographer") grants the Client a non-exclusive, non-transferable, license for Personal Use of the digital images.

  • What you can do: Print images for personal display, share them on personal social media accounts, and use them for personal gifts (e.g., photo albums for family).

  • What you cannot do: Sell the images, enter them into contests, or use them for any commercial, business, or promotional purposes without written consent from the Photographer.

2. Intellectual Property & Copyright

The Photographer retains all statutory and common law Copyright in all images. This license is for use, not ownership of the original files.

3. Image Alterations & Editing

To maintain the integrity of the Photographer's work:

  • The Client may not apply filters (e.g., Instagram filters), crop the images in a way that alters the composition significantly, or otherwise edit the files.

  • If a specific edit is required (e.g., blemish removal or color adjustment), please contact the Photographer directly.

4. Social Media & Attribution

We love it when you share your photos! When posting to social media:

  • Credit is appreciated: Please tag @DeLaMoraPhoto or link to www.DeLaMoraPhoto.com

  • No Commercial Tags: You may not tag or allow third-party vendors (e.g., makeup artists, venues, clothing brands) to use these images for their own advertising without the Photographer's permission.

5. Gallery Maintenance & Archiving

  • Access: This gallery will remain active for 90 days from the date of delivery.

  • Responsibility: It is the Client’s responsibility to download and backup their images in a secure location (e.g., external hard drive or cloud storage) immediately upon receipt.

  • Liability: The Photographer is not responsible for the loss of images once the gallery has expired or if the Client fails to download the files.

6. Storage and Limitation of Liability

Upon delivery of the online gallery, the Client assumes full responsibility for the safety and storage of the digital files.

  • Client Responsibility: The Client is strictly responsible for downloading and creating back-up copies of all images to their own hardware or cloud storage before the gallery expiration date.

  • No Long-Term Storage Guarantee: The Photographer is under no contractual obligation to maintain, store, or archive the images after the gallery has expired. The Photographer shall not be held liable for any loss, damage, or corruption of files once the images have been delivered and the gallery access period has ended.

  • Archival Retrieval: At the Photographer’s sole discretion, if the images are still available in the Photographer’s offline archives after the gallery has expired, they may be retrieved upon request. A non-refundable retrieval fee of $150.00 will apply to locate the files, re-upload them, and reactivate the gallery for a limited time.
